This Seller Agreement (“Agreement”) governs your participation as a Seller on FindMyStudDog.com (“FMSD,” “we,” “our,” or “us”). This Agreement is supplemental to the FindMyStudDog Terms of Service, which are incorporated by reference. In the event of a conflict between this Agreement and the Terms of Service, the Terms of Service will control. Capitalized terms not defined in this Agreement have the meanings given to them in the Terms of Service.
1. Seller Role & Responsibility
As a Seller, you agree to provide stud services in a professional, accurate, and reliable manner.
You are solely responsible for:
- The accuracy of your listings and the truthfulness of all health records and documentation submitted to the Platform
- The condition and health of your stud dog
- The collection, handling, and shipment of semen
- Compliance with all applicable laws and breeding standards
FMSD does not assume responsibility for your services, animals, or outcomes.
2. Listing Requirements
3. Health Records Verification
Health records verification is required to list a stud dog on the Platform. Sellers agree to submit accurate, unaltered veterinary and genetic records, and to update those records as needed.
Required documentation:
- One genetic test appropriate to the breed
- At least one additional health screening, such as hips, elbows, cardiac, or eyes, as determined by applicable breed standards
- A brucella test performed within the last twelve (12) months
Sellers agree to keep brucella testing current and to notify FMSD if a stud’s health status changes.
Health records verification indicates documentation has been reviewed. It does not guarantee fertility, genetic outcomes, or breeding success.
Documents submitted for verification are not published. FMSD reviews them and issues a certificate summarizing the verified results, which is displayed on the listing. Sellers agree that FMSD may issue and display such a certificate and that Buyers may share it.
Misrepresentation of health records may result in immediate listing removal, account suspension, or forfeiture of earnings.
4. Booking Obligations
5. Fulfillment & Collection Standards
Sellers are required to collect and ship semen on the confirmed booking date using accepted veterinary and industry practices for collection, handling, and packaging. Sellers must generate the shipping label through the Platform and deliver the shipment to the carrier in time to meet that day’s cutoff. Tracking is provided automatically once the label is generated.
Failure to Fulfill
If a Seller cannot fulfill on the scheduled date, a good faith effort must be made to fulfill the next available day if viable. If fulfillment is no longer viable, the booking may be deemed non-fulfillable. Repeated fulfillment failures may result in reduced visibility, listing removal, or account suspension.
Where a booking is deemed non-fulfillable due to Seller failure, FMSD may recover from the Seller any non-recoverable costs incurred, including payment processing fees and any shipping charges that cannot be refunded by the carrier. Such amounts may be deducted from current or future payouts.
6. Shipping Responsibilities
7. Semen Quality & Handling
8. Pricing & Transparency
Sellers set the stud fee and the collection cost. The collection cost must reflect the actual cost of collection, handling, and preparation charged by the Seller’s veterinarian, and is subject to the maximum permitted by the Platform.
Shipping is calculated by FMSD at checkout based on the destination. Sellers do not set or include shipping in their listed pricing.
All amounts a Buyer will pay to the Seller must be disclosed at the time of listing. Additional fees may not be requested after a booking is confirmed, and Sellers may not request payment outside the Platform for any part of the transaction.
Failure to disclose full pricing, or inflating the collection cost beyond actual cost, may result in listing removal or penalties.
9. Seller-Defined Terms
Sellers may define additional terms related to rebreeding policies, guarantees, and timing requirements. FMSD reserves the right to review, modify, or refuse enforcement of any Seller-defined terms deemed unreasonable, misleading, or inconsistent with platform standards. Seller-defined terms are supplemental to the Terms of Service and the Dispute and Refund Policy. In the event of a conflict, the Platform documents will control.
Seller-defined terms are displayed on the listing and form part of the agreement between Buyer and Seller when the Buyer completes payment.
Where a Seller offers a rebreeding, the rebreeding may be used with a different female belonging to the same Buyer unless the Seller’s terms state otherwise. A rebreeding waives the stud fee; collection cost, shipping, and platform fees still apply, and the rebreeding booking remains subject to the Seller’s approval.
10. Communication & Platform Use
11. Payments & Payouts
12. Content License
13. Live Breedings
Live breeding is not currently offered through the Platform. If FMSD enables live breeding in the future, the following terms apply.
Where a Seller offers live breedings, the Seller is responsible for providing a safe and clean facility, ensuring the stud dog is healthy and current on vaccinations, and communicating all terms and conditions related to the live breeding prior to the Buyer’s arrival. FMSD does not supervise, attend, or participate in live breedings. The Seller is responsible for any injury, illness, or facility-related issue that arises from conditions within the Seller’s control.
14. Stud Unavailability
15. Compliance with Law
Sellers are responsible for ensuring that their breeding operations and use of the Platform comply with all applicable local, state, and federal laws and regulations, including any licensing, permit, or registration requirements applicable to breeding or the sale of stud services in their jurisdiction.
