Buyer Agreement – FindMyStudDog

This Buyer Agreement (“Agreement”) governs your participation as a Buyer on FindMyStudDog.com (“FMSD,” “we,” “our,” or “us”). This Agreement is supplemental to the FindMyStudDog Terms of Service, which are incorporated by reference. In the event of a conflict between this Agreement and the Terms of Service, the Terms of Service will control. Capitalized terms not defined in this Agreement have the meanings given to them in the Terms of Service.

By submitting a booking request or completing a transaction through the Platform, you agree to comply with this Agreement.

1. Buyer Role and Responsibility

As a Buyer, you are responsible for making informed breeding decisions and ensuring that all necessary preparations are in place for a successful breeding.

FMSD does not guarantee breeding outcomes and does not provide veterinary or genetic advice.

2. Booking & Payment

Buyers agree to submit accurate booking requests, provide complete and truthful information, and pay the full transaction amount through the Platform prior to shipment. All payments must be processed through FMSD. Off-platform payments are prohibited.

As part of the booking process, Buyers are required to provide information about their female dog, including breed, weight, and self-reported health testing status. Buyers represent that all self-reported information is accurate and truthful. FMSD reserves the right to request verification of any self-reported health data at any time and at its sole discretion. Failure to provide requested verification may result in cancellation of the booking, denial of claims, or account action.

Buyers may book a second shipment against a confirmed booking without a new approval from the Seller. Each shipment is a separate order with its own payment, fees, and hold period, and is subject to the same terms as the first.

3. Fees

Transactions include a Stud Fee set by the Seller, a Collection Cost set by the Seller, shipping calculated at checkout, a Buyer Protection Fee charged by FMSD, and a Transaction Fee charged by FMSD to cover payment processing.

The Buyer Protection Fee and Transaction Fee are non-refundable except at FMSD’s discretion.

A second shipment does not carry a Stud Fee. The Buyer Protection Fee on a second shipment is charged at a flat rate rather than as a percentage.

Fee amounts are disclosed prior to completing a transaction.

Applicable sales tax is calculated at checkout based on the delivery destination and collected by FMSD as a marketplace facilitator where required. Tax amounts are shown before you complete a transaction.

4. Timing Responsibility

The Buyer is solely responsible for determining the correct breeding timing, including progesterone testing and interpretation. FMSD and the Seller are not responsible for improper timing, delayed ovulation, or inaccurate progesterone readings. Claims related to unsuccessful breeding due to timing will not be considered valid grounds for refund, credit, or rebreeding unless explicitly stated in the Seller’s terms.

5. Seller Terms and Guarantees

Each Seller defines their own breeding terms, which may include rebreeding policies, timing conditions, and shipment guarantees. Buyers agree to review and accept a Seller’s terms prior to booking. FMSD may review Seller terms but does not guarantee outcomes. Seller-defined terms are supplemental to the Terms of Service and the Dispute and Refund Policy. In the event of a conflict, the Platform documents will control.

6. Shipment and Delivery Responsibilities

Buyers are responsible for providing accurate delivery information, being available to receive shipments, and coordinating with their veterinarian for timing.

If delivery is attempted and missed, or if the carrier holds the shipment for collection, the Buyer is responsible for retrieving it promptly. Delays caused by missed delivery or delayed collection are not grounds for refund.

FMSD monitors shipment status and will notify the Buyer of delivery, delays, and carrier exceptions, but the responsibility to receive or collect the shipment remains with the Buyer.

7. Signature & Delivery Risk

FMSD determines carrier service level and delivery options, including whether signature confirmation is required. Where a shipment is delivered without signature, the Buyer assumes the associated risks of loss, delay, or misdelivery at the delivery address.

8. Carrier Delays

Buyers acknowledge that third-party carriers such as FedEx and UPS may experience delays. FMSD and Sellers are not responsible for carrier delays or resulting breeding timing issues. Additional shipments requested due to carrier delays may require additional payment and will be subject to Seller terms.

9. Semen Handling and Veterinary Responsibility

Upon delivery, Buyers are responsible for proper handling and storage of semen and for the use of qualified veterinary professionals. FMSD and Sellers are not responsible for improper handling, veterinary error, or post-delivery outcomes.

10. Documentation Requirements

To submit any claim, including claims related to semen quality or unsuccessful breeding, Buyers must provide documentation from a licensed veterinarian. Acceptable documentation may include ultrasound reports, x-ray reports, or written veterinary statements. Documentation must be submitted within required timeframes and must be verifiable upon request. FMSD may request additional documentation at any time. Failure to provide documentation may result in denial of claims or loss of protections.

11. Veterinary Verification Authorization

By submitting any claim or supporting documentation, the Buyer agrees to provide verifiable records from a licensed veterinarian. If additional verification is required, the Buyer agrees to cooperate by authorizing their veterinarian to confirm the provided information. Failure to provide documentation or authorize verification upon request may result in denial of the claim, loss of eligibility for rebreeding or guarantees, or account suspension.

12. Fulfillment Timing & Seller Delays

Sellers are expected to fulfill bookings on the confirmed date. If a Seller is unable to fulfill, a next-day attempt may be made if viable. If fulfillment is no longer viable, the booking may be deemed non-fulfillable. In such cases, the Buyer will receive a full refund of all amounts paid, including the stud fee, collection cost, shipping, Buyer Protection Fee, and Transaction Fee, and may pursue an alternative stud. FMSD may recover the payment processing costs associated with the refund from the Seller. All determinations are made at FMSD’s discretion.

13. Cancellations and Refunds

Before Shipment

If a Buyer cancels before shipment, the stud fee, collection cost, and shipping will be refunded. The Buyer Protection Fee and Transaction Fee are non-refundable. Where a shipping label has already been purchased, refund of shipping is subject to the carrier’s ability to void the label.

After Shipment

Once shipment has been initiated, transactions are considered final. No cancellations or refunds will be issued unless otherwise provided under the Dispute and Refund Policy.

Exceptions

FMSD may issue refunds or credits at its sole discretion in cases of verified seller failure or material misrepresentation.

14. Live Breedings

Live breeding is not currently offered through the Platform. If FMSD enables live breeding in the future, the following terms apply.

Where a Buyer elects a live breeding instead of shipped semen, the Buyer acknowledges and accepts the additional risks involved, including but not limited to injury to either animal, disease transmission, and facility conditions. The Buyer is solely responsible for travel arrangements, associated costs, and ensuring their female dog is healthy and current on vaccinations. FMSD does not supervise, attend, or participate in live breedings. All terms related to the live breeding, including location, timing, and handling, are agreed upon between the Buyer and Seller. FMSD is not responsible for any injury, illness, or dispute arising from a live breeding.

15. Compliance with Law

Buyers are responsible for ensuring that their use of the Platform and any breeding activities comply with all applicable local, state, and federal laws and regulations, including any licensing or permit requirements for breeding in their jurisdiction.

16. General Terms

The following provisions of the Terms of Service apply to Buyers and are incorporated by reference: Disputes and Resolution (Section 13), Prohibited Conduct (Section 15), Assumption of Risk (Section 16), Limitation of Liability (Section 17), Indemnification (Section 18), Modifications to Terms (Section 19), Governing Law and Dispute Resolution (Section 20), Disclaimer of Warranties (Section 21), and Electronic Communications (Section 22). In the event of any conflict between this Agreement and the Terms of Service, the Terms of Service will control.
